Dubai Courts, DIFC Courts or ADGM Courts: Which Court Can Hear Your Commercial Dispute?

A practical starting point for businesses assessing a commercial claim in Dubai or Abu Dhabi.

The first question is whether a court has jurisdiction over your claim. Choosing a forum simply because it is convenient, or because the contract is in English, can leave a business facing unnecessary procedural disputes.

Read the whole dispute resolution clause

Start with the signed agreement, schedules and later amendments. Identify the parties’ legal names and read the governing law clause alongside the dispute resolution clause. A governing law provision addresses which law governs the agreement; a court jurisdiction clause addresses which court is to hear the dispute. An arbitration clause creates a different route.

For example, a supply contract may refer to English law but name a particular court or provide for arbitration. The reference to English law alone does not select the DIFC Courts or ADGM Courts. Check for negotiation, notice or mediation requirements as well.

How the three court routes differ

Starting points for a civil or commercial jurisdiction assessment
ForumWhat to examine first
Dubai CourtsThe relevant UAE jurisdiction rules, defendant’s location, transaction and place of contractual performance, together with any dispute clause.
DIFC CourtsA relevant statutory DIFC connection or an express written agreement selecting the DIFC Courts for a civil or commercial dispute.
ADGM CourtsThe ADGM jurisdictional framework, relevant connection and any written request by the parties conferring jurisdiction.

Dubai Courts

Dubai Courts are a potential route for civil and commercial claims within their jurisdiction. A review should consider the parties’ locations and where the agreement was made, performed or due to be performed, as relevant under the applicable rules. Documents ordinarily need to be in Arabic or legally translated for filing.

For unpaid invoices, collect the agreement, orders, delivery records and payment correspondence. For construction claims, add notices, certificates, variations and project records. These materials help assess both the route and the claim. Explore Dubai Courts dispute services.

DIFC Courts

Under Dubai Law No. (2) of 2025, the DIFC Courts have specified jurisdictional gateways involving DIFC bodies, establishments, contracts and transactions. The law also allows civil and commercial jurisdiction through specific, clear and express written agreement before or after a dispute arises. Proceedings are conducted in English.

A clause expressly selecting DIFC Courts can therefore be significant even where the parties are outside DIFC. Its exact wording and applicability still need assessment. Explore DIFC Courts legal practitioner services.

ADGM Courts

ADGM’s framework directly applies English common law. Its Court of First Instance hears civil and commercial disputes under the applicable regulations, including jurisdiction conferred by the parties’ written request. The ADGM Courts’ published guidance excludes criminal, family and estates or inheritance disputes.

For property matters, identify the precise location, transaction dates and applicable framework. Do not assume all Abu Dhabi property disputes belong in ADGM. Explore ADGM Courts dispute services.

What if the contract provides for arbitration?

Examine the validity and scope of the arbitration agreement, the chosen rules and seat, and whether preliminary steps apply. Court involvement in arbitration-related applications is a separate question from which forum decides the contractual merits. Avoid treating a court clause and an arbitration clause as interchangeable.

Mediation may offer a settlement route, including under an agreed sequence of negotiation, mediation and arbitration. Review deadlines and the agreement before taking the next step. Explore arbitration and mediation counsel.

Five questions to bring to your lawyer

  1. Who are the correct parties, and what are their legal names and locations?
  2. What do the contract and amendments say about governing law, courts, arbitration and notices?
  3. Where did the relevant events or contractual performance take place?
  4. What relief is needed, and are there existing proceedings or urgent deadlines?
  5. Where are the assets against which a judgment or award might be enforced?

Choosing suitable dispute counsel in Dubai

If your search begins with “best lawyer in Dubai”, narrow the choice to counsel familiar with your dispute, evidence and potential forum. Ask for a clear explanation of jurisdiction, available routes, likely work and fees. The appropriate strategy depends on your documents and objectives.
