Start with the right court and the right claim
A dispute connected to Dubai may involve unpaid invoices, a failed property transaction, defects in a construction project or a disagreement over a supply agreement. The initial assessment should identify who is legally responsible, what obligation was breached and which forum can hear the claim.
For civil and commercial disputes, jurisdiction can depend on the defendant’s location, the transaction and where contractual obligations were performed or were due to be performed. A court or arbitration clause also requires review. The fact that a party is in Dubai does not, by itself, resolve every jurisdiction question.
Commercial litigation, construction & trade
Advocate Suhail Rana advises clients on dispute strategy and works through IAB Advocates & Legal Consultants on Dubai Courts matters. The team’s work is shaped around the evidence, commercial priorities and the representation required for the particular proceedings.
- Debt recovery and unpaid invoices: review contracts, purchase orders, delivery records, payment acknowledgements and the calculation of the amount claimed.
- Construction claims: assess payment certificates, variations, delay allegations, defects, completion records and the contractual notice requirements.
- Trade and supply disputes: examine agreed specifications, delivery obligations, rejected goods, correspondence and loss records.
- Property disputes: review sale agreements, payment and handover records, alleged defaults and the appropriate route for the dispute.
- Company and shareholder disputes: consider the relevant agreements, authority to act, accounting records and the specific relief sought.
Evidence, experts and enforcement
A useful case file separates the chronology from the supporting documents. Technical or accounting disputes may require expert evidence. We help clients identify records that support their position and address disputed calculations or expert findings.
Dubai Courts filings ordinarily require Arabic documents or an approved legal translation. Translation, court fees and expert expenses should be considered alongside the legal work. A judgment also needs an enforcement plan: identifying the debtor and available assets is part of assessing the practical value of a claim.
From the first consultation to a case strategy
- Identify the dispute: explain who owes what, the amount involved, the key dates and the result you want.
- Review the documents: assess the agreement, notices, payments and the other party’s position, including evidence that may weaken the claim.
- Agree the next step: discuss settlement, further document review or proceedings, with the scope and fees confirmed before engagement.
What to prepare for your Dubai Courts consultation
Prepare the signed agreement and amendments, a short dated chronology, invoices and payment records, relevant notices, and any court papers already received. Highlight hearing dates and response deadlines. Start your enquiry with a brief overview; the office will explain the documents needed for a detailed review.
Common questions about hiring a Dubai Courts lawyer
Can you help recover unpaid invoices in Dubai?
We can assess the unpaid balance, the contractual payment terms and the supporting evidence. Bring invoices, purchase orders, proof of delivery, payment records and correspondence about any disputed work. The appropriate recovery route depends on the documents and the dispute. Read the unpaid invoice document checklist.
What if I have received court papers or a hearing notice?
Contact the office promptly with the case number, the notice, the date it was received and any stated deadline. A response requires review of the actual papers; do not assume that an enquiry or consultation request extends a deadline.
How do I choose the best lawyer in Dubai for a court dispute?
Consider experience relevant to your type of dispute, the professional authorisation needed for the proceedings, who will handle the work and how fees are agreed. Ask for an explanation of the evidence, risks and practical next steps. A search position does not establish a lawyer’s suitability for your case.
Can an English contract be used in a Dubai Courts claim?
An English contract can be relevant evidence. Approved Arabic translation will ordinarily be needed for filing. The contract’s governing law and dispute resolution wording must also be checked.
How long will the case take, and what will it cost?
The estimate depends on the claim, service, contested issues, expert work, procedural stage and any appeal. Consultation and engagement fees are confirmed by the office after the scope is identified.
Can I file in Dubai Courts if the contract mentions arbitration?
The clause needs legal assessment before filing. Its validity, scope and the applicable procedural requirements can affect the available route. Share the complete agreement rather than only the clause.
